Terms of Service

1.1 Definitions

These Terms of Service set out the rules for using the sign-up form for the waitlist for the launch of the Stellawise application.

Defined terms:

• Waitlist - the sign-up form for notification of the launch of the Stellawise application, available at stellawise.app
• User / You / Your - a natural person who has signed up for the Waitlist and is at least 16 years old
• Application - the future online educational tool for analysing cosmetic ingredients (INCI) using AI, planned for launch in Q1 2026
• INCI - International Nomenclature of Cosmetic Ingredients

1.2 Scope of these Terms

These Terms apply only to signing up for the Waitlist. They do not govern use of the Application - separate terms for the Application will be made available before its launch and will require separate acceptance.

1.3 Acceptance of these Terms

Signing up for the Waitlist constitutes acceptance of these Terms. If you do not agree with any of the provisions, do not sign up for the list.

Acceptance takes place by ticking the relevant checkbox in the sign-up form (one for the Terms, a separate one for the Privacy Policy).

1.4 Changes to these Terms

We reserve the right to change these Terms. We will inform you of changes by email to the address provided when signing up for the waitlist.

Changes take effect 14 days after notification. If you do not agree with a change, you can unsubscribe from the list at any time at no cost (the “unsubscribe” link in every email).

2.1 What signing up for the Waitlist includes

By signing up for the Waitlist you will receive:

1. An email notification of the launch of the Stellawise Application.

2. Priority (early) access to the Application before its public launch.

3. Beta tester status (after registering in the Application at the time of its launch).

4. A maximum of 1-2 emails with important product information before launch.

2.2 Beta tester benefits

Persons signed up for the Waitlist who register in the Application at the time of its launch as beta testers receive:

1. Free access to the Application's basic features with no time limit.

2. “Basic features” means the scope defined in the Application's terms at the time of its launch.

3. Stellawise may introduce additional premium features in the future, which may be paid, but the basic scope remains free for beta testers.

4. Priority in testing new features before they are publicly released.

5. The opportunity to provide feedback that influences product development.

2.3 What signing up for the list does NOT mean

Signing up for the Waitlist does not mean:

1. Automatic creation of an account in the Application (you create your account yourself after the Application launches).

2. Immediate access to the Application's features (the Application is in preparation).

3. A guarantee that the Application will launch by a specific date.

4. A commitment by Stellawise to launch the Application - in exceptional situations (e.g. discontinuing the project), Stellawise may decide not to launch the Application, in which case it will inform those signed up for the list.

2.4 Nature of the information on the website

The stellawise.app website presents information about the planned Application for informational purposes. Content concerning the Application's future features is in the nature of an announcement and may change before the Application launches.

2.5 About the nature of the future Application

The Stellawise Application will be an educational tool for analysing cosmetic ingredients (INCI) using artificial intelligence (AI).

1. It will not be a medical service or dermatological advice.

2. It will not replace consultation with a doctor.

3. It will use AI systems, which may contain errors and require user verification.

The full terms for the Application - including information about usage restrictions (among others, for pregnant and breastfeeding women, and for persons with serious skin conditions - in these cases consultation with a doctor will be required) - will be made available before the Application launches and will require separate acceptance.

Signing up for the Waitlist does not require disclosing any health information. Such information will only be relevant to using the Application after its launch.

3.1 Who can sign up

To sign up for the Waitlist you must:

1. Be at least 16 years old (in accordance with the GDPR).

2. Provide a genuine and active email address.

3. Accept these Terms and the Privacy Policy.

3.2 Restrictions

Stellawise may block or remove an email address from the list in the event of:

1. Repeated sign-ups of the same address.

2. Suspicion of automation (bots, scripts).

3. Email addresses from prohibited domains or addresses that are obviously false.

4. Technical abuse (e.g. attempts to disrupt the form's operation).

4.1 Permitted use

You may use the sign-up form only for the personal, non-commercial purpose of receiving notification of the Application launch.

4.2 Prohibited use

The following are prohibited:

1. Signing up other people's email addresses without the owner's consent.

2. Using the form for commercial purposes (e.g. spam, marketing).

3. Scraping data from the website.

4. Automated sign-ups (bots) without Stellawise's consent.

5. Attempts at reverse engineering, decompilation or decoding of the website.

6. Attempts to circumvent security measures or technical limits.

7. Sending malware, spam or phishing.

8. Impersonating other people.

5.1 Our property

All content available on the stellawise.app website, including the logo, the name “Stellawise”, the design and the website code, texts, graphics, photos, and educational and informational materials, is our intellectual property and is protected by law.

You may not copy, modify or use it without our written consent.

6.1 Stellawise is not liable for

1. Non-delivery of email notifications for technical reasons (e.g. spam filter, email provider error).

2. Interruptions in the website's operation (planned or unplanned).

3. Decisions made on the basis of information about the planned Application presented on the website.

4. Changes in the Application's functionality compared to the information presented before launch.

5. Delays in launching, or failure to launch, the Application.

6.2 Stellawise does not guarantee

1. Uninterrupted operation of the website.

2. Compatibility with all devices and browsers.

3. A specific launch date for the Application.

4. Free access to the Application after its launch.

6.3 Liability for third parties

We use third-party providers (e.g. an email service provider, hosting). We are not responsible for failures of their systems or for these providers' privacy policies.

6.4 The limitations of liability do not apply

to cases of liability for intentional acts or gross negligence, in accordance with mandatory applicable law.

Key principles:

1. We collect only your email address.

2. We use it solely to notify you of the Application launch.

3. We don't sell your data.

4. You have full GDPR rights (access, rectification, erasure, objection, withdrawal of consent).

5. You can unsubscribe from the list at any time (the “unsubscribe” link in every email).

8.1 Unsubscribing by you

You can unsubscribe from the Waitlist at any time by:

1. Clicking the “unsubscribe” link in any email from us.

2. Sending an email to hello@stellawise.app requesting removal.

After you unsubscribe, your email address will be removed from the list in accordance with the Privacy Policy.

8.2 Ending the list by Stellawise

Stellawise may discontinue the Waitlist (e.g. after the Application launches or if the project is discontinued). We will notify you of such a decision by email at least 30 days in advance.

9.1 Governing law

These Terms are governed by Polish law.

9.2 Amicable dispute resolution

Before taking a matter to court, we undertake to attempt to resolve the dispute amicably.

Procedure:

1. A complaint should be submitted to: hello@stellawise.app.

2. Content: a description of the problem, the date, documents and a proposed solution.

3. Confirmation: within 3 business days.

4. Resolution: within 30 business days.

9.3 Competent court

If no amicable resolution is reached:

1. Consumers: the court with jurisdiction under the provisions of the Polish Code of Civil Procedure (usually the court of the consumer's place of residence).

2. Consumers from another EU country: the contract is governed by the law of the consumer's country. The consumer may sue Stellawise before a court in their own country or in Poland.

9.4 Out-of-court dispute resolution (ADR)

As a consumer, you have the right to out-of-court dispute resolution through certified ADR bodies in Poland:

1. Consumer Ombudsman: uokik.gov.pl/rzecznicy-konsumentow

2. Permanent Consumer Arbitration Courts at the regional Trade Inspectorate offices: uokik.gov.pl/kontakt-inspekcja-handlowa

10.1 Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Stellawise regarding sign-up for the Waitlist. Ambiguous provisions are interpreted in favour of the consumer.

10.2 Severability

If a court or administrative authority finds any provision invalid, the remaining provisions remain in force. The invalid provision will be replaced with a valid one of similar effect.

10.3 No waiver of rights

Our failure to exercise any right under these Terms does not constitute a waiver of that right.

10.5 Languages

These Terms are available in Polish (the authentic and binding version) and in English (a translation for convenience). In the event of any discrepancy, the Polish version prevails.

This is only a summary. In the event of a legal dispute, the full text of the Terms above prevails.

What you can do

1. Sign up for the waitlist and receive notification of the Application launch.

2. Unsubscribe at any time (link in every email).

What you can't do

1. Sign up other people's email addresses.

2. Use the form commercially, scrape data or use bots.

3. Sign up if you are under 16.

Remember

1. Signing up for the list does not mean access to the Application - only notification of its launch.

2. The Application will launch with separate terms that will require acceptance.

3. We don't guarantee a specific launch date or free access.

4. Details about personal data are in the Privacy Policy.
